Legacy National Bank Privacy Policy and Notice
At Legacy National Bank, we know you expect the customer service banks gave customers in years past with the technology that is afforded customers today. We know that with technology comes the requirement of strict privacy in your financial transactions; and those are at the very foundation of our relationship with you, our customer. We want you to be aware of our promise to safeguard the information you share with us, no matter how you interact with us; whether it’s in person, by phone, at the ATM or on the Internet.
This privacy policy and notice outlines important information. We will inform you of how we collect, use and safeguard customer information. You will also be informed on how to direct your requests to us not to share certain types of information between any organization with which we may affiliate with in the future.
We will provide you with a privacy notice each year as long as you have a relationship with Legacy National Bank. If we make material changes to our notice, we will inform you of these changes. We will also post our updated privacy notice on our website, www.legacyar.com.
This privacy policy will apply to information about current and former customers of Legacy National Bank. If you open another account or obtain a product or service at Legacy National Bank, we may provide you another copy of this privacy notice. This privacy policy was initially adopted by the bank’s board of directors on March 15, 2005 and updated on October 19, 2010.
Information We Collect
We collect the following types of non-public information about our customers:
- Income, marital status, age, driver’s license and social security numbers and other information from applications and other forms you complete;
- Loan payment history, account balances and other information about transactions you conduct with us, our affiliated organizations and others;
- Credit scores or credit history from credit reporting agencies and other information such as demographic information and insurance claims information we receive from third parties.
All of this information is termed 'Customer Information'.

Customer Information is used to provide you with quality customer service and value for the products and services you obtain from us. In the future, you will benefit by Legacy National Bank sharing Customer Information; as it will save you time because you may not have to supply our affiliated organizations with the same information.
Privacy for Internet Users
Our commitment to safeguard your privacy also extends to the Internet. If you are just browsing through our website, we do not request any personally identifiable information, nor do we collect unique identifying information about you unless you voluntarily and knowingly provide us that information, such as when you send us an email or complete an application online. If you provide us this information, it is only used internally and in furtherance of the purpose for which it was provided.
Our Internet financial services provider, Fiserv may collect general information on our website simply to help us provide banking and other financial services to you online. They collect certain information on our behalf for security and statistical purposes. The information collected for these purposes may include:
- The Internet address (referral site) which brought you to our web site;
- The date and time you access our site;
- The name and version of your web browser;
- The Internet service provider you used when you accessed our site;
- Your Internet Protocol (IP) address; and
- The pages visited in our website.
Fiserv may use cookies to collect this general information on the website. They also use cookies for security purposes in our Internet Banking service.
In the future, we may use aggregate, general, non-personally identifiable information to help us market our products and services that may be of interest you.

Internet Protocol (IP) Addresses
An IP address is a number that's automatically assigned to your computer whenever you're on the Internet. Web servers, the computers that "serve up" Web pages, automatically identify your computer by its IP address.
When collecting information for us, Fiserv does not link IP addresses to anything personally identifiable, which means that a user's session will be logged, but the user remains anonymous.
Fiserv may use IP addresses to audit the use of our site. They can and will use IP addresses to identify a user when necessary for security purposes.
What is a Cookie?
A cookie is a very small text file sent by a web server and stored on your hard drive, your computer’s memory, or in your browser so that it can be read back later. Cookies cannot “read” information about you from your computer or be used to “steal” information about you; and cookies don’t carry viruses. Cookies are a basic way for a server to identify you (most cookies actually identify the computer you happen to be using at the time, not you personally). Cookies are used for many things from personalizing start up pages to facilitating online purchases. Cookies help sites recognize return visitors and they perform a very important function when you engage in secure Internet banking. For your security, we do not store any of your personal information in our cookies. The cookies used in our Internet banking system are further described below.
Internet Banking Cookies
Fiserv uses encrypted cookies that do not pass to your computer’s hard drive. Instead, the cookie is stored in your computer’s memory, identifying only your computer while you are logged on. Only Fiserv can read the information in these cookies. This Internet banking cookie allows Fiserv to process multiple transactions during your session without requiring you to reenter your pass code for each individual transaction. The cookies for Internet banking simply provide another level of security for our Internet banking product. When you log off, or close your browser, the cookie is destroyed. A new cookie is used for each session. That way, no one can use the prior cookie to access your account. For additional security, the cookie expires after 15 minutes of inactivity. It must then be renewed by reentering your pass code. Fiserv does not (and cannot) use this cookie to collect or obtain new personal information about you. You must allow your browser to accept this cookie so you can use the Internet banking system.
Accessing Your Information
We limit our employee’s access to Customer Information. Employees are trained and permitted to access Customer Information only when it will help you do business with us or help us do business with you. We maintain safeguards that comply with government regulations to safeguard Customer Information.
Email Policies
In the future we may send you email notices for certain disclosures if you choose to accept electronic disclosures or statements. We may also send you email to market our products and services that may be of interest you. We may also provide you an opportunity to subscribe to a newsletter; however, we may provide you an opportunity to opt-out of these advertising promotions if required by law. Fiserv may send these emails as an agent on our behalf.
Restrictions on Sharing Information with Outside Companies
Legacy National Bank does not sell Customer Information to outside companies to use for their own marketing purposes.
Customer Information may be provided to outside organizations which provide us services (such as data processing, printing or mailing) or help us provide you with products or services you request (such as brokerage transactions, check printing or underwriting insurance applications) in order to provide you these products and services. We may also provide Customer Information to companies that perform marketing services for us or to financial institutions with which we have joint marketing agreements. Any and all of these companies are contractually obligated to keep your Customer Information confidential. Customer Information may also be shared with others when it is required or permitted by law, such as to credit bureaus or to comply with law enforcement subpoenas and/or summons.
Information Shared Between Our Affiliated Organizations
Legacy National Bank strives to provide our customers with quality customer service. Sharing Customer Information among our affiliated organizations is important. We may share application or credit information about customers with our internal broker(s), insurance representative(s), or other affiliates because they may offer a product or service that may benefit you more than the company with which you are currently dealing. However, if you do not want us to share application and credit information with another company in our organization, please call us at (877) 717-1900 or (479) 717-1900 and ask for the Operations Department. When you call, someone will be able to answer your questions about our privacy practices. If you choose, you may request that we not share application or credit information within our organization. You should know that if you ask that we not share Customer Information in this way, you may not receive information about our products or services that may benefit or be of interest to you. Once you call us and request that we not share this type of Customer Information, there is no need to make this request again.
Also, be aware that even if you do ask that we not share application or credit information about you with any affiliated companies, we are permitted by law to share transaction and experience information (i.e. account balances and payment history) within our organization.
If you have a joint account, we will treat a request not to share credit or application information by one account holder as applying only to that account holder unless the customer notifies us that he/she is acting on behalf of the other account holder(s). If your insurance policy names more than one person as the insured parties, we will treat a request not to share this type of information by one insured as applying only to that person unless he/she notifies us that he/she is acting on behalf of the other insured party.
Credit Bureau Disputes
If you disagree with any of the information reported regarding account performance and would like to submit a dispute to Legacy National Bank or request Legacy National Bank review the information reported to the credit bureau (s) regarding payments, payment history, or account status, please submit your dispute to the following address and include your name, specific information as to why you are disputing the information reported and copies of any documentation that you may have in your possession that could help us investigate your dispute (such as cancelled checks, etc):

Health Information
We may collect personal health information, like medical reports, for certain types of insurance policies. We do not share personal health information with anyone except as necessary to underwrite the policy, administer claims, or as otherwise requested by you or as required or permitted by law.
